Why do UK universities keep losing legal cases?

Some of the country鈥檚 biggest institutions have suffered bruising defeats of late despite the justice system generally favouring the powerful. What explains this losing streak and will it change anything?

The belated obsession this winter with the Post Office scandal 鈥 in which workers were wrongly prosecuted for embezzling funds 鈥 shows the UK鈥檚 enduring fascination with a David versus Goliath-style legal fight in which underdogs take on the establishment.

Part of the draw of such battles lies in the fact that the Davids, by their nature, seldom win.

Yet for universities 鈥 ostensibly the Goliaths in any fight聽owing to the聽power and resources at their disposal 鈥 legal victories have been hard to come by of late. Instead they have been racking up a series of damaging defeats, with potentially wide-ranging ramifications for the sector.

First Jo Phoenix, a former Open University professor,聽successfully sued the institution聽for harassment and unfair dismissal after being forced to leave her post over her gender-critical views.

David Miller, a professor of political sociology,聽similarly argued he had been wrongly sacked聽by the University of Bristol due to 鈥減rotected beliefs鈥 鈥 this time his anti-Zionism 鈥 and won, making clear he聽would be seeking 鈥渕aximum compensation鈥 for the damage done to his career.

The same institution was at the centre of another landmark case heard at the Court of Appeal, which聽upheld an earlier judgment聽that the institution contributed to the suicide of one of its students, Natasha Abrahart, by failing to adjust its assessments.

Even one of the country鈥檚 most wealthy and powerful institutions, the University of Oxford, has not been immune to this losing streak: two tutors, Alice Jolly and Rebecca Abrams,聽successfully proved at tribunal聽that they should not have been kept on personal services contracts for the 15 years they worked for the institution.

Meanwhile, UCL聽failed in its attempts聽to ensure complaints from students聽about its teaching during Covid and industrial action were dealt with by its own processes rather than the courts, and this potentially seismic case remains ongoing. In a lesser-reported ruling, the University of Portsmouth had to pay 拢450,000 to an Indian academic, Kajal Sharma, who was not given a job during what was described as a selection process 鈥渢ainted by race discrimination鈥.

Smita Jamdar, head of education at Shakespeare Martineau, said the law firm鈥檚 own increased caseload in recent years appeared to confirm that the sector had become more litigious, with the cases that make it to a ruling only the 鈥渢ip of the iceberg鈥.

She put this down to several factors, the main one being that staff and students had聽become increasingly aware of their rights and聽were often encouraged by third parties to test evolving areas of law. These sorts of cases have also benefited from the emergence of crowdfunding and conditional-fee arrangements, which have helped with the often huge costs associated with making claims.

Much of the recent litigation has its roots in the UK鈥檚 influential Equality Act, passed in 2010. Ms Abrahart鈥檚 parents鈥 use of the act was familiar: they argued that people with disabilities 鈥 their daughter had a severe anxiety disorder 鈥 should not face discrimination. Dr Sharma also relied upon the act鈥檚 well-established protections against racism.

But in the Phoenix and Miller cases, its use was more novel, and both managed to stretch the act鈥檚 definition of 鈥減rotected philosophical beliefs鈥 to include their views.

Shortly after these cases concluded, there were reports that Jim McCambridge, a professor in public health at the University of York, had initiated legal action over his 鈥渁nti-tobacco views鈥, which he claimed should also be a protected belief.

David Ruebain, who helped draft the legislation when he was director of legal policy at the Equality and Human Rights Commission, told a recent Universities UK conference that 鈥渘one of us really contemplated how far the belief element would go when we were crafting that piece of legislation鈥.

鈥淚鈥檓 not saying that the case law is going against the intention 鈥 I don鈥檛 think that鈥檚 true. But I don鈥檛 think there was a contemplation of the way it would evolve at the time, which鈥aises interesting challenges when we are trying to think about free speech matters,鈥 said Professor Ruebain, now pro vice-chancellor for culture, equality and inclusion at the University of Sussex.

Protected beliefs have provided a framework for academics in employment cases, but聽it is not always a comfortable fit, said James Murray, legal director at Doyle Clayton, especially as one of the tests for such a belief is that it is unchangeable regardless of any new evidence.听

Recent cases聽had been the first time that tribunals聽had engaged with academic freedom issues in any meaningful way, he added, so a聽鈥済enerous view鈥 was that universities聽were struggling because they聽were grappling with聽鈥渧ery challenging areas at the cutting edge of equality law鈥.

鈥淚 think they probably will keep losing these cases because this interaction between employment protection under the Equality Act and academic freedom is very far from getting sorted out properly,鈥 said Mr Murray, also a research fellow at the University of Buckingham.

鈥淭he courts need to do a lot of work to work out how these two things interact. Even with the best will in the world, it is going to be hard for universities to know what鈥檚 safe for them to do.鈥

Institutions聽often find themselves in a lose-lose position in legal cases, according to Ms Jamdar, because they often involve staff and students who have diametrically opposed views.

鈥淯niversities are having to make almost impossible judgements,鈥 she said. 鈥淭hey know, whatever they decide, somebody is going to be deeply unhappy and increasingly willing to take that through to some sort of challenge.

鈥淚t is not that there is an easy legal answer they are just not spotting; they are trying to balance a huge range of very complex rights and responsibilities and, ultimately, you can鈥檛 satisfy everybody.鈥

Given this, some have argued that聽academic聽issues 鈥 particularly free speech 鈥 should not be the domain of the legal system at all but should be settled by debate and discussion.听

鈥淎s soon as these things end up in a courtroom, a decision has to be made,鈥 said Eric Heinze, professor of law and humanities at Queen Mary University of London. 鈥淚t becomes an all-or-nothing, exclusive dichotomy. Almost by definition, I don鈥檛 think courts have that competence. I don鈥檛 think anybody has that competence. It is just arbitrary.鈥

Professor Heinz said that, as the purpose of a university was to consider hard ideas, they 鈥渘eed to find ways of dealing with this themselves instead of passing the buck to people who have no more competence, and arguably less competence鈥.

But many have lost faith that universities are able to handle these things internally, which is precisely why they are turning to the courts instead.

鈥淚nternal systems in universities are completely controlled by those universities,鈥 said Wyn Evans, an astrophysics professor at the University of Cambridge and co-founder of the 21 Group, which supports victims of bullying and discrimination in academia. 鈥淭hey are not fair. In fact, I would use a stronger word; I would say they are often corrupt.

鈥淎 university can choose who the investigator is, they can choose who is on the appeal panel. At all times they are guided by their legal department,聽which advises there might be difficulties with conceding things at an early stage.

鈥淣o one wants to go to court; it is a time-consuming operation and is very nerve-racking, and any court case carries a risk. Nobody came into academia to end up suing their university, so it is very interesting to see all these cases and, I think, it points to a failure of the internal processes of a university.鈥

Ms Jamdar took a kinder view. 鈥淪ometimes the issue is that you can鈥檛 resolve it yourself,鈥 she said. 鈥淏ecause you are dealing with competing rights on campus, unless everybody is willing to reach an agreement on how to move forward, you are going to have to make a decision that somebody is likely to be unhappy about.鈥

Universities grappling with how to reconcile these complex issues will soon face a further added complication in the form of the Office for Students鈥櫬free speech complaints scheme, which will open a new avenue for those with grievances.

But given that the regulator has said its only concern is whether speech is lawful or unlawful 鈥 while the courts have focused more on the conduct and actions of those involved in a case 鈥 the different routes聽might lead to different outcomes, Ms Jamdar warned.

鈥淚t is going to be a nightmare, frankly,鈥 she said. 鈥淚 think universities are going to have to accept there may be more litigation, and they are going to lose more cases.鈥

This does not mean that nothing can be learnt from the rulings that have come before, she said.

鈥淲e would say you can鈥檛 ignore these judgments. They give you a really valuable insight into how the law will be applied to what you do on a day-to-day basis,鈥 she said.

鈥淏ut they are not precedent. It is not simply a matter of, 鈥業f you do it exactly like this, you鈥檒l be fine.鈥 It is more thinking about what themes are coming through these cases, what they are telling us about the culture within universities, the way we do things and how that might need to evolve.鈥

The chance to聽affect this wider picture is also often what motivates those bringing claims, with the most recent cases drawing on several long-standing grievances in the sector 鈥 from casualised contracts to the quality of teaching.

Professor Evans, of the 21 Group, said universities聽were scared of only two things 鈥 legal action and bad publicity 鈥 so using the courts聽would always be one of the most effective ways of driving change.

鈥淚 hope that happens because I think universities are a Post Office scandal waiting to happen,鈥 he said. 鈥淭here are some very serious problems in the sector.鈥

You know what they say, "Make 2 lawyers happy, sue someone today". It's a sorry state of affairs when people cannot reach some kind of accommodation by discussing issues, something which requires flexibility and understanding on both sides. Far too often, at least one party if not both just digs their heels in and refuses to budge an inch.
Not helped by the modern propensity of academics to engage in a social media 鈥榩ile on鈥 (to use the phrase in the Phoenix judgement) - or in social media 鈥榤obbing鈥 as alternatively described - based on a limited knowledge or in fact total ignorance of the facts of a particular issue and rooted in a pervasive group-think/orthodoxy within parts of academe. And 鈥榤anagement鈥 fails to address such 鈥榤obbing鈥 - indeed even participates as in the Phoenix saga! No wonder HE is losing public trust.
The increased costs of legal proceedings (especially the UCL case mentioned above) combined with the lack of funding mentioned in another THE article on tuition fees will only hasten the collapse of universities already teetering on the brink of financial oblivion. Change is inevitable in life but I suspect what we will see is the collapse of many public universities and the rise of more expensive, less regulated private ones
The comments by Professor Wyn are spot on, and that is exactly my own experience too. It's a gross failure of people management skill and ability, and a highly adversarial approach - which is often completely avoidable. I'm sorry to say that legal challenge and bad publicity being the only things which cut through is a very accurate summary.
Wyn Evan's comments equating universities with the Post Office scandal is well worthy of exploration and greater curiosity. So many dark things have happened in our major institutions, there's no reason not to believe that universities are immune, and might even be much worse.
I am waiting for the law suits on health and safety at work, and the standard working week Will be interesting to see what arguments the universities put forth for some unhealthy practices that have led to staff burnout and sadly demise.
Why do universities think sacking people for expressing particular views is reasonable? If they are not breaking the law, either ignore them or put forward the opposing arguments. I no longer know which views could land someone in trouble. Trans athletes competing in female competition? Hasn't Lord Coe banned that? Israel taking over the West Bank because the USA has never objected? That's the the view of many of many sober moderate people in my circle of acquaintances. Religions are dangerous superstition? That was the predominant view of my friends and me back in the 1970s. Universities' only concern now appears to be not upsetting students and commercial partners. It's not going to end well.
There is to much emphasis on the protected belief cases. Only two of the cases mentioned in the article have a free-speech angle. Racist hiring processes (Portsmouth) , inability to take responsibility for reduced student experience during strikes (UCL), abusing non-employee contracts (Oxford), dismissing people who were not genuinely redundant (Leicester), protection of student mental health (Bristol). None of these are connected to free speech, but this article focuses only on the two that are, and therefore misses the bigger picture.
Most people give up on taking up their grievances as they feel their careers will be adversely affected or that it would just be too stressful to fight back. So the cases that that do end up going to court are just the tip of the iceberg. There is way too much subjectivity in assessing performance and contribution in an academic job and so easily lends itself to being abused. It would appear that in many places, useless HR managers are essentially there to support the management and do their bidding regardless of moral or sometimes even legal considerations. Some people have taken it upon themselves to fight back, often at great personal cost to themselves but hopefully for the greater good.
